Catering Event Terms

A.            Prices; Sales Tax. The total cost of the catering event is shown above as the total due. This amount includes all applicable sales tax and other charges described in the contract above.

B.            Changes. You may request changes to the date, time and/or location of the catering event or to the menu items ordered, provided that your request is made at least seven (7) days in advance of the originally scheduled date. Due to Golden Caterings LLC commitments to personnel, suppliers and other customers, no changes may be made less than seven (7) days prior to the originally scheduled date.

C.            Other Vendors. In the event Client requires services which Golden Caterings LLC does not provide; Golden Caterings agrees to assist Client in finding a vendor to provide such services. However, the selection and hiring of any vendor is at the sole discretion and responsibility of Client. Golden Caterings LLC does not assume any responsibility in any way for Vendor, including but not limited to negligence, non-performance or other conduct by vendors.

D.            Other Responsibilities of the client. You are responsible for all city, county or other permits or licenses required for your catering event.

 

 

Terms of Payment

A.            Deposit. A deposit of 50% of the total charges is required 30 days prior to your event. The remaining balance is due prior to your scheduled event. The amount of the deposit and the due date of the deposit are specified in this Agreement. The receipt of your deposit by Golden Caterings LLC will confirm the reservation of your catering event and must be received by said date for your reservation to be held. The full amount of the deposit will be credited against the total charges due for the catering event. If you must cancel your catering, you must inform Golden caterings LLC 7 days prior to your scheduled catering. Failure to give notice of cancellation within 7 days of your scheduled catering will forfeit your deposit.  

B.            Balance Due. Golden Caterings LLC will issue a final contract showing the amount of food and beverage ordered and the amount of total charges to be billed for services, less any deposits and prior payments.

 If prior billing arrangements have been made in writing from Golden Caterings LLC payment in full is due no later than 14 days from the billing date. Any accounts that are past due by more than 30 days, the service will be cancelled until payment in full has been made. These accounts will also be charged monthly at 5% rate on the total outstanding amount until payment in full is made.  Any account that Golden Caterings LLC or any representative of Golden Caterings LLC must collect, the debtor will be responsible for all incurred expenses. This includes but is not limited to any and all legal fees.

 

 

 

Loss by Guests

Golden Caterings LLC assumes no responsibility for damages or losses incurred by the Client or Client’s guests or attendees at the catering event. Golden Caterings LLC also assumes no responsibility for any food, beverages, floral arrangements, décor or items, either personal or professional, or any other items whatsoever brought by anyone other than Golden Caterings LLC to the catering event whether prior to, during or after the catering event. Client agrees to be solely responsible for all guests and attendees at the event and the acts of the guests and attendees. Client agrees to pay for any and all damages arising out of the catering event, except and to the extent of any negligence or misconduct by Golden Caterings LLC.

 

 

Limitation of Liability

You agree that Golden Caterings LLC, its officers, directors, employees, owners, agents, contractors and suppliers shall not be liable for any claims, losses, liabilities, or expenses relating to the catering event for any amount in excess of the fees paid by Client to Golden Caterings LLC pursuant to this Agreement, except to the extent a final judicial determination has been made finding Golden Caterings LLC in breach from gross negligence, bad faith or intentional misconduct. In no event shall Caterer or its officers, directors, employees, owners, agents, contractors or suppliers be liable to you or any third party for any punitive, special, exemplary, incidental, consequential or other indirect loss or damage (including but not limited to loss of profits, loss of revenue, loss of opportunity and loss of use) that may arise out of or in connection with this Agreement.

 

Guest Count

A final guarantee of attendance must be received by Golden Caterings LLC catering office seven (7) days prior to your event. This number is not subject to reduction. You will be charged for the guarantee or the number attending, whichever is greater, any overage will be due immediately.

Per person price quoted is based on the number of guests stated in this Agreement.  If guest count drops below quoted guest count, the quoted price per person is subject to increase.

Leftovers are the responsibility of the customer; Golden Caterings LLC does not provide to go container unless requested and listed in the equipment section of the contract.

Any food items taken by you, your guests or any attendee of this event are the responsibility of the taker to adhere to all safe food handling practices. In any event Golden Caterings LLC will in no way be held reasonable for any items taken from this event.

 

Right to Rescind

Golden Caterings LLC reserves the right, at any time, to unilaterally rescind this Agreement and, or to deny service, even after the catering event has commenced, if the catering event is not conducted (or any guests or attendees of the catering event do not conduct themselves) in a manner consistent with the law and the safety standards of Golden Caterings LLC.

 

Disposables and Dishware

Disposable dinnerware and glassware will be included at your event if noted in this Agreement and will be billed at an additional fee.   Golden Caterings LLC reserves the right to charge an additional fee for handling of glass plates, silverware, and glasses that you provide or are provided by your rental facility. An additional fee would include washing, drying, packing, crating and returning them to their proper storage container. Please inquire for a specific price in this rare instance.

 



Schedule a Tasting

A $25 per plate fee will be charged. If you do decide to use our services, this fee will be deducted from the final bill. No refunds of the tasting fee will be refunded if the event is cancelled.

 

 

Caterer's Trademarks

Any use of Golden Caterings LLC name, logos, trademarks, service marks of graphics in connection with your catering event, whether in the form of printed materials, signs at the catering event, or electronic, digital or other media is subject to review and prior written approval from Golden Caterings LLC. Golden Caterings LLC reserves all rights to its name, logos, trademarks, service marks and graphics, and you are not given any license to use or any of the foregoing by entering into this Agreement.

 

 

Governing Law and Venue

The laws of the State of Missouri shall govern this Agreement. If a dispute arises in connection with or relating to this Agreement, it shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in Springfield, Missouri and the parties’ consent to the personal and exclusive jurisdiction and venue of these courts.

 

Use of Video or Photos

Golden Caterings LLC has permission to use any photos, videos, or images of this event in their marketing, advertising, websites, or any other campaign they should choose. Images may also be used online.

 

 

Force Majeure

Golden Caterings LLC will be excused from the performance of this Agreement in whole or in part if the performance by Caterer of any of its material obligations under this Agreement is prevented by operation of law or any cause beyond the reasonable control of Caterer, including without limitation, fire, flood, disruption of transportation (but not the failure of a party to reasonably anticipate possible transportation delays), earthquake, public disaster, strike, labor dispute or unrest, accident, breakdown of electrical or other equipment, riot, war, insurrection, civil unrest, Act of God, any act of any legal or governmental authority (all of which causes are referred to as “events of force majeure”). If the event is cancelled or curtailed because of the occurrence of any of the foregoing events of force majeure, and the event is not rescheduled, Golden caterings LLC will remit the full portion of the deposit less any out-of-pocket costs incurred by Golden Caterings LLC in connection with the cancelled or curtailed event.

 

 

Entire Agreement

This Agreement constitutes the entire Agreement between the parties and supersedes any and all prior offers, negotiations and agreements. Only a written agreement executed by the parties shall modify this Agreement. If any provision of this Agreement is declared invalid, the remaining provisions shall remain in full force and effect. The section and paragraph headings contained in this Agreement are for reference purposes only and shall not affect in any way the meaning or interpretation of this Agreement.

 

Golden Caterings, LLC does not add a gratuity to the bill unless requested by the customer. We believe that a gratuity is a reward for doing a good job, so we let the customer determine the gratuity that they would like to give. Gratuity is always greatly appreciated!
